Please read these Terms of Service ("Terms") carefully before using the https://picklemix.app website (the "Service") operated by Picklemix ("us", "we", or "our").
Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you do not have permission to access the Service.
When you create an account with us, you guarantee that you are at least 13 years of age, and that the information you provide is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account.
By creating an account, you confirm that you are a real individual and agree to cooperate with any reasonable human verification steps we may request. Failure to complete such verification may result in suspension or termination of your account.
You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
The following terms apply when you opt in to receive SMS text messages from Picklemix:
Consent to receive SMS messages is not required as a condition of purchasing any goods or services from Picklemix.
Supported carriers include but are not limited to: AT&T, Verizon, T-Mobile, Sprint, U.S. Cellular, and most other major U.S. carriers.
WhatsApp notifications are coming soon. When available, similar terms will apply. You will be asked to opt in separately before receiving any WhatsApp messages.
By creating an account, you may opt in to receive email notifications about your events and account activity. You may opt out of marketing or promotional emails at any time by following the unsubscribe link in any email we send or by updating your Notification Preferences. Transactional emails related to your account (such as password resets and email verification) will still be sent regardless of your email preferences.
Our Service allows you to post, link, store, share, and otherwise make available certain information, text, graphics, or other material ("Content"). You are responsible for the Content that you post, including its legality, reliability, and appropriateness.
By posting Content on the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display such Content solely for the purpose of operating and providing the Service.
By participating in events on the Service, you grant Picklemix a perpetual, irrevocable, worldwide, royalty-free license to store, display, and use your event data — including game scores, match results, standings, and event participation records — for the purpose of operating the Service, generating statistics, and maintaining historical records. This license survives account deletion.
Event results are shared data. Other participants in the same event have a legitimate interest in the accuracy and availability of those results. You may not unilaterally require the removal of event data that involves other participants.
The Service calculates player ratings based on game results. Ratings are enabled by default and can be disabled per event by the event organizer, or as a default preference in your account settings. Drill and practice events are never rated.
Rating calculations are provided for informational and entertainment purposes. Picklemix makes no guarantees regarding the accuracy, fairness, or suitability of any rating for any purpose. Ratings may be recalculated, adjusted, or reset at our discretion to improve the system.
You may delete your account at any time from your profile settings. When you delete your account:
Some parts of the Service may be billed on a subscription basis. You will be billed in advance on a recurring basis. At the end of each billing cycle, your subscription will automatically renew unless you cancel it. Payment is processed by Stripe; we do not store your payment card details.
Refund requests are considered on a case-by-case basis at our sole discretion.
The Service and its original content, features, and functionality are and will remain the exclusive property of Picklemix and its licensors. The Service is protected by copyright, trademark, and other applicable laws.
Our Service may contain links to third-party websites or services not owned or controlled by Picklemix. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.
We reserve the right to suspend or terminate accounts that violate these Terms, have been inactive for an extended period, or are reasonably suspected to be non-human or automated. We reserve the right to require additional verification steps at our discretion to confirm that an account represents a real individual, and users are expected to cooperate with such requests. Upon termination, your right to use the Service will cease immediately.
In no event shall Picklemix, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the Service.
The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We reserve the right to modify these Terms at any time. If a revision is material, we will provide at least 30 days notice before the new terms take effect. By continuing to use the Service after revisions become effective, you agree to be bound by the revised Terms.
